These Terms of Use ("Terms") govern your access to and use of the mobile application
TheUp, our related website and APIs (together, the "Services"), provided by
7Stockapp OÜ (registry code 16976938), Lahtri tn 12, 15551 Tallinn, Estonia
("we", "us", "our"). By downloading, accessing or using the Services
you agree to be bound by these Terms.
If you do not agree to these Terms, you must not access or use the Services. These Terms are intended as a general template
and do not constitute legal advice. Please consult your legal advisor to ensure these Terms are appropriate for your situation.
1. Our Services
TheUp is an AI-powered motivation and personal growth assistant designed to help you clarify your goals,
stay motivated and track your progress. Through the Services, you can:
- receive motivational messages and push notifications tailored to your profile and activity;
- record and manage your projects, goals and personal motivations;
- chat with an AI assistant to receive suggestions and reflections;
- save words, notes and other content related to your personal development.
The Services are not a substitute for professional medical, psychological, coaching, legal or financial advice.
You remain solely responsible for decisions you make based on information generated by the Services.
2. Eligibility and Account
- You must be at least 16 years old or the minimum age required by law in your jurisdiction to use the Services.
- You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
- You agree to provide accurate and up-to-date information and to notify us promptly of any unauthorised use of your account.
3. Acceptable Use
You agree not to:
- use the Services for any unlawful, fraudulent, abusive or harmful purpose;
- submit content that is defamatory, hateful, threatening, discriminatory or otherwise violates the rights of others;
- attempt to probe, scan or test the vulnerability of any system or network or breach any security or authentication measures;
- interfere with or disrupt the integrity or performance of the Services, including by placing an unreasonable load on our infrastructure;
- reverse engineer, decompile or attempt to derive the source code of the app, except to the extent allowed by applicable law;
- use automated means (such as bots or scrapers) to access the Services without our prior written consent.
4. Subscriptions, Billing and App Store / Google Play
TheUp may be offered in a free version and one or more paid subscription plans (for example, "Premium") providing additional features,
higher limits or exclusive content.
4.1 Purchases Through App Stores
- Paid subscriptions and in-app purchases are processed by the Apple App Store or Google Play Store (the "App Stores"), not directly by us.
- Your purchase, payment information, billing cycle, refunds and cancellation are governed by the terms and policies of the applicable App Store.
- We do not collect or store your full payment card details.
4.2 Subscription Term and Renewal
- Subscriptions are typically offered on a weekly, monthly or yearly basis and will automatically renew at the end of each term unless you cancel.
- You can manage or cancel your subscription at any time through your App Store account settings.
- Cancelling a subscription will prevent future renewals but does not usually entitle you to a refund for the current billing period, unless required by the App Store’s rules or applicable law.
4.3 Prices, Trials and Changes
- Prices, features and available plans may change over time. Any price changes will be communicated via the App Stores or the Services where required.
- We may offer free trials or promotional offers at our discretion. If you do not cancel before the end of a trial, you may be charged for the next billing period according to the applicable plan.
5. AI-Generated Content and Disclaimers
The Services use third-party AI providers such as OpenAI and Google to generate content and suggestions based on your inputs and history.
AI-generated outputs may sometimes be inaccurate, incomplete, biased or inappropriate.
- You should treat AI responses as suggestions only, not as facts or professional advice.
- You remain responsible for reviewing and evaluating any AI-generated information before acting on it.
- You should never rely solely on the Services for decisions relating to your health, safety, finances, legal matters or other areas where professional advice is required.
6. Intellectual Property
The Services, including all software, design elements, logos, text, graphics and other content (excluding your own content),
are owned by or licensed to us and are protected by copyright, trademark and other laws.
- You are granted a limited, non-exclusive, non-transferable, revocable licence to use the Services solely for your personal, non-commercial purposes.
- You may not copy, modify, distribute, sell, lease or otherwise exploit the Services or any part thereof without our prior written consent.
7. Your Content
You retain ownership of the content you submit to the Services (for example, your projects, motivations, notes and chat messages),
subject to any rights granted to us under these Terms.
- You grant us a worldwide, non-exclusive, royalty-free licence to host, store, process and display your content as necessary to operate and improve the Services.
- You confirm that you have the rights necessary to submit the content and that it does not infringe the rights of any third party.
8. Service Availability and Changes
- The Services are provided on an "as is" and "as available" basis. We do not guarantee that they will be error-free, uninterrupted or available at all times.
- We may modify, suspend or discontinue any part of the Services at any time, including particular features, plans or content, with or without notice.
- Where reasonably possible, we will try to notify you in advance of any material changes that significantly affect your use of the Services.
9. Limitation of Liability
To the maximum extent permitted by law, we and our directors, employees, contractors and partners shall not be liable for:
- any indirect, incidental, special, consequential or punitive damages;
- any loss of profits, revenue, data or goodwill;
- any damage arising from your use of, or inability to use, the Services, including reliance on AI-generated content.
Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under applicable law.
10. Term and Termination
- These Terms apply from the moment you first use the Services and remain in effect until terminated.
- You may stop using the Services at any time and may delete your account where such functionality is available.
- We may suspend or terminate your access to the Services if you materially breach these Terms or if required by law or by our partners (including App Stores).
11. Governing Law and Disputes
Unless mandatory law provides otherwise, these Terms and your use of the Services are governed by the laws of Estonia,
without regard to its conflict of law rules. The specific choice of forum and dispute resolution mechanism should be
confirmed with your legal advisor to ensure compliance with applicable consumer protection and jurisdiction rules.
12. Changes to These Terms
We may update these Terms from time to time. We will post the updated version on this page and update the "Last updated" date.
Where legally required or where changes are material, we may also notify you through the app or by email.
